The City of Dallas filed a request on Dec. 26 to a state appeals court, asking to reverse the temporary injunction that blocks the city’s efforts to prohibit short-term rentals (STRs) in residential areas.
In a decision on Dec. 6, Dallas County District Judge Monica Purdy approved a temporary injunction for STRs in response to the lawsuit. Last week, the City asked the Court of Appeals to review the case.
According to the updated injunction order, a group of operators challenged the City by presenting evidence that the new zoning ordinance would ban 95% of STRs within Dallas city limits.
Last year, a group of short-term rental operators sued the city over new regulations that would prohibit them from having properties in single-family neighborhoods. The enforcement of STRs continuing to operate was scheduled to begin in December but was delayed due to the injunction.
“The city is considering its options regarding an appeal of the temporary injunction,” city attorney Tammy Palomino said in a statement at the time. “In the meantime, the city will continue enforcement of its existing ordinances governing minimum property standards, disturbing noises and private nuisances.”
A non-jury trial is set for June 3 at 9:00 a.m. in the 95 Judicial District Court of Dallas County.
